Before you Ride

I, the undersigned, hereby acknowledge and agree to rent the Surron electric dirt bike (hereinafter referred to as "the Surron") from Pono Rydahz (hereinafter referred to as "the Rental Company"). I understand and agree to the terms and conditions outlined in this Consent and Liability Form, which are in addition to any other rental agreement or policies provided by the Rental Company.

**1. Consent and Assumption of Risk:**

I understand that operating the Surron involves inherent risks and dangers, including but not limited to accidents, injuries, property damage, and even death. I hereby consent to the rental and use of the Surron and voluntarily assume all risks associated with its operation, maintenance, and usage.

**2. Safety and Protective Gear:**

I acknowledge that I am responsible for using appropriate safety gear, including but not limited to a helmet, gloves, and sturdy footwear, during the rental period. I understand that failure to use proper safety gear increases the risk of injury and releases the Rental Company from any liability related to such negligence.

**3. Rental Use and Restrictions:**

I agree to use the Surron only for its intended purpose and in a safe and lawful manner. I will not operate the Surron under the influence of alcohol, drugs, or any substances that impair my ability to safely ride the vehicle.

**4. Compliance with Laws and Regulations:**

I agree to abide by all local, state, and federal laws and regulations pertaining to the operation and use of electric dirt bikes during the rental period.

**5. Condition of the Surron:**

I have examined the Surron and acknowledge that it is in good working condition and free from any visible defects or damages. In case of any issues or concerns, I will immediately notify the Rental Company.

**6. Liability Release:**

I release, indemnify, and hold harmless the Rental Company, its employees, agents, and representatives, from any and all liability, claims, losses, damages, expenses, or actions arising from or related to the rental, possession, or use of the Surron, including but not limited to any injuries, damages, or losses sustained during the rental period.

**7. Property Damage:**

I am responsible for any damage to the Surron during the rental period. I agree to pay for any repairs or replacements required as a result of my use of the Surron, except for normal wear and tear.

**8. Security Deposit:**

I acknowledge that the Rental Company may require a security deposit to cover any potential damages or violations during the rental period. I agree that the security deposit can be used to cover any outstanding fees, damages, or losses.

**9. Age and Legal Capacity:**

I certify that I am at least 18 years old and possess the legal capacity to enter into this rental agreement. If I am renting the Surron for a minor, I certify that I am the legal guardian and assume all responsibilities and liabilities associated with their rental and use of the Surron.

**10. Personal Insurance:**

I understand that Pono Rydahz insurance may not cover personal injuries or property damages I may incur during the rental period. I acknowledge the importance of carrying adequate personal insurance and agree to do so at my discretion.

I have read and understood the terms and conditions of this Consent and Liability Form, and I voluntarily and knowingly accept and assume all risks associated with the rental and use of the Surron.

By signing this form, you acknowledge that you have read and understood the terms and conditions and agree to be bound by them throughout the rental period.
